ADVICES (Ethics):
15-526 (Katz):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon a
borough council member with regard to receiving
compensation for performing plowing or other work
related to the borough’s roads.
15-527 (Fisher):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon an
individual serving as a borough administrator,
secretary, and treasurer with regard to seeking
election or simultaneously serving as a school
director.
15-528 (Casciola):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon an
individual serving as a township supervisor, who
along with his wife owns a small office building
located in the township, with regard to leasing space
in such building to a municipal authority which
currently leases space in the township municipal
building.
15-529 (Whitehead):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon an
individual serving as a school director with regard to
voting on a collective bargaining agreement between
the school district and the education association
representing the school district’s teachers, where: (1)
the individual is employed as a tenured professional
employee (teacher) in a different school district; and
(2) in the aforesaid employment capacity, the
individual is a participant in the Public School
Employees’ Retirement System.
15-530 (Graybill):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,

would impose prohibitions or restrictions upon an
individual serving as a school director, who in a
private capacity is an owner of a one-third interest in
an advertising company that sells logoed apparel,
with regard to such company selling apparel to
various school groups associated with the school
district.
15-531 (Bodnar, Jr.):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon an
individual employed as the Director of Planning and
Development for Carbon County with regard to
seeking election or simultaneously serving as a
township auditor.
15-532 (Wert):
Re: Whether, following termination of employment
with and part ownership of a corporation named
“Herbert H. Metz, Inc.,” which serves as the appointed
Engineer for Franconia Township, the Public Official
and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. §
1101 et seq., would permit you to become an
appointed alternate engineer or MS4 Consultant for
Franconia Township separate from Herbert H. Metz,
Inc.
15-533 (Logan):
Re: Whether the Public Official and Employee Ethics
Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would
impose restrictions upon employment of an Executive
Deputy Secretary for Administration for the
Pennsylvania Department of Environmental
Protection following termination of Commonwealth
employment.
15-534 (Berti, Jr.):
Re: Whether, pursuant to Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), an individual who would be
elected as a township supervisor would have a
conflict of interest with regard to participating in
matters before the township board of supervisors that
would financially impact a volunteer fire department
that serves the township, where the individual is a
trustee of the volunteer fire department.
15-535 (Ambrose):
Re: Whether, pursuant to Section 1103(a) of the
Public Official and Employee Ethics Act (“Ethics Act”),
65 Pa.C.S. § 1103(a), an individual who would be
appointed as a school director would have a conflict

of interest with regard to participating in matters
before the school district school board that would
pertain to the school district’s insurance package,
where the individual is currently the broker of record
for the school district and its insurance package.
15-536 (Savage):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a
Fisheries Biologist 2 following termination of
employment with the Pennsylvania Fish and Boat
Commission (“Fish and Boat Commission”).
15-537 (Schoch):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon a Senior Advisor to
the Governor following termination of Commonwealth
employment.
15-538 (Ingram):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a Civil
Engineer Consultant – Transportation following
termination of employment with the Pennsylvania
Department of Transportation (“PennDOT”).
15-539 (Shearer):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon a
school director, who in a private capacity is employed
as a substitute bus driver with a bus company that
has a multiyear contract with the school district, with
regard to participating in discussions, deliberations, or
votes pertaining to: (1) the contract between the
school district and the bus company; or (2) the
approval of drivers whom the bus company intends to
hire and assign to routes in the school district.
15-540 (Engstrom):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a
Transportation Construction Inspector following
termination of employment with the Pennsylvania
Department of Transportation (“PennDOT”).
15-541 (Moran, Sr.):
Re: Whether: (1) the Chief Public Defender of
Lackawanna County; or (2) part-time or full-time
Assistant Public Defenders with the Lackawanna

County Office of the Public Defender would be
considered public officials/public employees subject to
the Public Official and Employee Ethics Act (the
"Ethics Act"), 65 Pa.C.S. § 1101 et seq., and the
Regulations of the State Ethics Commission, 51 Pa.
Code § 11.1 et seq., and particularly, the
requirements for filing Statements of Financial
Interests.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a
Special Assistant to the Governor following
termination of Commonwealth employment.
15-543 (Rossey):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon an
individual with regard to simultaneously serving as a
member of council for the borough in which he
resides and a borough manager/secretary with a
different borough.

Re: Whether the activities of the Retail Energy
Supply Association (“RESA”) in hosting an energy
symposium (“the Symposium”) to educate its
members and interested parties on various topics
would constitute “lobbying” as that term is defined at
Section 13A03 of Pennsylvania’s lobbying disclosure
law (“Lobbying Disclosure Law”), 65 Pa.C.S. § 13A03,
where certain State officials and employees would be
invited to speak regarding energy policy and
regulation in the Commonwealth of Pennsylvania, and
a targeted list of State officials and employees would
be invited to attend.
