12-550 (Touchinsky)
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
borough council member with regard to
simultaneously serving as a member of the board of
trustees of a charter school.
12-551 (Minnich)
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of an
Assistant Chief Information Officer with the
Governor’s Office of Administration (“Office of
Administration”), Office for Information Technology
(“OIT”), following termination of employment with the
Office of Administration.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
Roadway Programs Coordinator following termination
of employment with the Pennsylvania Department of
Transportation (“PennDOT”).

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon an individual in
his capacity as a Member of the Lancaster County
Clean Water Consortium (“Clean Water Consortium”)
Steering Committee if the Clean Water Consortium
would contract for the services of LandStudies, Inc.
(“LandStudies”), a business with which the individual
is affiliated in his private capacity, in connection with
obtaining grant funding for a project; and whether the
Ethics Act would impose any restrictions upon the
individual in his capacity as a Member of the Board of
Directors of the Conservation Foundation of
Lancaster County (“Conservation Foundation”) if
LandStudies would bid on ecological restoration
projects related to a grant received by the
Conservation Foundation.

Re: Whether, as a Motor Carrier Enforcement
Officer with the Pennsylvania State Police under job
code 70751, you would be considered a “public
employee” subject to the Public Official and Employee
Ethics Act (the “Ethics Act”), 65 Pa.C.S. § 1101 et
seq., and the Regulations of the State Ethics
Commission, 51 Pa. Code § 11.1 et seq., and
particularly, the requirements for filing Statements of
Financial Interests.

would impose any restrictions upon employment of an
Acting Deputy Secretary of Education following
termination of service with the Pennsylvania

impose any restrictions upon employment of the
Director of the Bureau of Health Promotion and Risk
Reduction within the Pennsylvania Department of
Health following termination of Commonwealth
service.

Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
Legislative Specialist 1 following termination of
employment with the Pennsylvania Department of
Community and Economic Development (“DCED”).

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of
the Chief of Staff and Deputy Managing Director to
the Managing Director of the City of Philadelphia
(“City”) following termination of employment with the
City.
12-559 (Martyak):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
township supervisor with regard to participating in the
annual township budget process, including voting on
a township budget that would provide an allocation for
the township recreation board, where: (1) the

township recreation board oversees all recreation
funds, including those for youth sports and other
programs; (2) a non-profit athletic association runs the
youth sports programs in the township; and (3) the
township supervisor has resigned from serving, in a
private capacity, as an active member and president
of the athletic association.
12-560 (Ott):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon an
individual who was recently appointed as a school
director with regard to participating in discussions,
deliberations, or votes involving a proposed lease or
sale of existing unused school district property to a
community based non-profit group (“Group”), where:
(1) the Group would in turn build and operate a
community center (“Center”) that could be used by the
general public, staff, and students; and (2) before
becoming a school director, the individual personally
volunteered his time to serve in support of activities
related to the Center, but the individual did not serve
in a formal role on the Group’s board or any of the
Group’s committees.
12-561 (Durkin):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon the
nine current Members of the Scranton Composite
Pension Board (“Pension Board”), each of whom is an
active employee, retired employee, or elected official
of the City of Scranton (“City”), or an employee of
Lackawanna County who might receive a City
pension, with regard to a request by the City Mayor
for the Pension Board to consider investing up to
$16,000,000 into taxable City Municipal Bonds.
12-562 (Gustafson):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon an
individual in his public capacity as a city council
member if, in his private capacity as a building
contractor, the individual would be awarded a contract
with a local economic development agency for a
façade project that would be partially funded by a
grant from a city grant program.

12-563 (Foust):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
borough council member, whose daughter is a
borough employee and a member of the bargaining
unit that represents non-uniformed borough
employees, with regard to participating in discussions
in executive sessions of borough council pertaining to
a new labor contract with the bargaining unit or voting
on a new labor contract with the bargaining unit.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon an
administrator for a municipal authority, who has
inherited a collection of unused U.S. Postal Service
stamps, with regard to selling such stamps to the
authority for general mailing purposes.
