ADVICES (Ethics):
09-534 (Main):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would present any prohibitions or restrictions upon a
member and vice-chairman of a township board of
supervisors with regard to participating in or voting on
matters pertaining to a business that is drilling
methane gas wells in the area of the township, when:
(1) the business is affiliated with a local coal
company; (2) the local coal company leases land to
an individual (“the lessee”) who keeps her cattle on
the land; (3) the supervisor raises his own cattle and
has a verbal agreement with the lessee to keep his
cattle on the aforesaid leased land; (4) the supervisor
is not a party to the lessee’s lease with the local coal
company; and (5) the supervisor’s agreement with the
lessee existed before the business began its drilling
operations.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
probationary Transportation Construction Inspector
following termination of service with the Pennsylvania
Department of Transportation (“PennDOT”).

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of
the Director of the Bureau of Plans within the
Pennsylvania Emergency Management Agency
(“PEMA”) following termination of Commonwealth
employment.
09-537 (Riden):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would present any prohibitions or restrictions upon a
township supervisor’s fiancée with regard to serving
as a supervisor for the township.

09-538 (Caramanico):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would permit an engineering and design firm (“the
firm”) to enter into an agreement or arrangement with
a charter school for use of the school’s gymnasium or
classroom facilities for a fee, for the firm’s employee
wellness program, when the chairman of the board of
directors of the firm is a member and chairman of the
board of trustees of the charter school, and if so,
whether the restrictions of Section 1103(f) of the
Ethics Act, pertaining to contracting, would apply to
such agreement or arrangement.
09-539 (Then):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon an
individual with regard to performing the duties of a
borough council member if she would be elected to
such position, when: (1) the individual’s spouse has a
business that tows for the borough police department
pursuant to a verbal agreement and not a written
contract; (2) towing for the borough police department
is shared on a bi-monthly basis between the spouse’s
business and another towing business located within
the borough; (3) the vehicle owner is always
responsible for payment of the towing costs when the
borough police department requests towing for any
reason; and (4) neither the borough nor the borough
police department receives any compensation from
the vehicle owner or the business that performs the
towing.
09-540 (Easton):
Re: Whether the Public Official and Employee Ethics
Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq., would
impose any prohibitions or restrictions upon a
township commissioner with regard to receiving
reimbursement from the township for attending a
conference hosted by the Pennsylvania Rural Water
Association when: (1) the township is a member of
the Pennsylvania Rural Water Association; (2) the
commissioner is in charge of the township water and
sewers; (3) the commissioner is a Pennsylvania state-
certified water and wastewater operator; (4) the
commissioner would receive continuing education
credits toward his state certification for attending
classes at such conference; and (5) the township has
a policy that it will pay for attendance at a conference
that pertains to township business.

09-541 (Semerod):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
deputy administrator of a county mental health and
mental retardation program, who in a private capacity
is a licensed social worker, with regard to providing
psychotherapy to clients as an independent contractor
to a private company where: (1) the company is
initiating service delivery in the county; and (2) the
county will have a contractual agreement with the
company to provide start up monies to the company
and purchase services from the company.

Re: Whether, as the Public and Legislative Affairs
Manager of the Urban Redevelopment Authority of
Pittsburgh (“URA”), you would be considered a “public
employee” subject to the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.;
and if so, whether, upon terminating your employment
with the URA, you would be restricted as to private
employment with a consulting company in performing
work on contracts between the consulting company
and organizations with which URA Board Members
work.
09-543 (Young):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of
the Director of the Bureau of Facilities Management
within the Pennsylvania Department of General
Services (“DGS”) following termination of
Commonwealth service.
09-544 (Magnusson):
Re: Whether as a member of a township planning
commission, you would be considered a “public
official” subject to the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
and the Regulations of the State Ethics Commission,
and particularly, the requirements for filing Statements
of Financial Interests.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
District Maintenance Manager/Highway Maintenance
Manager following termination of service with the

Pennsylvania Department of Transportation
(“PennDOT”).
09-546 (Lamb):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. §1101 et seq.,
would impose any prohibitions or restrictions upon an
individual serving as the Controller of the City of
Pittsburgh, who in a private capacity is an attorney
licensed to practice law in Pennsylvania, with regard
to engaging in the private practice of law in general;
and whether the Ethics Act would impose any
prohibitions or restrictions upon such individual with
regard to serving as an “of counsel” member of a law
firm that may do business with the City of Pittsburgh
or its related authorities, where: (1) the individual
would not be involved with any City or City authority
related work; (2) the individual would receive no
compensation for City or City authority related work;
and (3) the individual would not be an equity member
sharing in the joint profits of the law firm.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
Transportation Construction Manager 2 following
termination of service with the Pennsylvania
Department of Transportation (“PennDOT”).
09-548 (Kennedy):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of an
Assistant Regional Director, with a working title of
Environmental Program Manager, following
termination of service with the Pennsylvania
Department of Environmental Protection (“DEP”).
09-549 (Hartman):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon
either of two township commissioners with regard to
participating in negotiations, meetings, discussions,
and written and electronic communications pertaining
to a contract with the bargaining unit for the
township’s employees or voting on a contract with
such bargaining unit when: (1) the spouse of one
township commissioner is a township employee and
member of the bargaining unit; and (2) the other
township commissioner is not employed by the

township but is a member of the bargaining unit
through a different employer.
09-550 (Duncavage):
Re: Whether as an Administrative Specialist 2 with
the City of Philadelphia under job class specification
2L17, you would be considered a “public employee”
subject to the Public Official and Employee Ethics Act
(the “Ethics Act”), 65 Pa.C.S. § 1101 et seq., and the
Regulations of the State Ethics Commission, and
particularly, the requirements for filing Statements of
Financial Interests.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
Transportation Construction Manager 1 following
termination of service with the Pennsylvania
Department of Transportation (“PennDOT”).
09-552 (Rubenstein):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
township council member with regard to participating
in discussions and negotiations pertaining to a new
labor contract between the township and a bargaining
unit or voting on a labor contract with such bargaining
unit when the township council member is a member
of the same union district council through his
employment as a district lottery representative with
the Pennsylvania Department of Revenue.
09-553 (Knowlton):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon an annuitant who,
following retirement from the Commonwealth of
Pennsylvania, has provided services to the
Pennsylvania Department of Public Welfare pursuant
to 71 Pa.C.S. § 5706(A.1) (“the 95-day annuitant
program”), with regard to accepting a position with an
independent non-profit organization designated by the
Governor as the agency to provide protection and
advocacy for persons with developmental disabilities,
mental illness, and other disabilities.
09-554 (Meyer):
Re: Whether Section 1103(e) of the Public Official
and Employee Ethics Act (“Ethics Act”), 65 Pa.C.S. §
1103(e), would impose any prohibitions or restrictions
upon an individual (“Fellow”) with regard to accepting

an appointed position with the City of Philadelphia
Board of Ethics (“Board of Ethics”) through a public
interest fellowship program (“the Program”)
established by a law firm (“the Firm”) where: (1)
pursuant to the Program, the Fellow would choose
from among options for serving with a non-profit
organization, a governmental agency, or an academic
institution; (2) the Fellow would be considered an
unpaid volunteer at the Board of Ethics; and (3) the
Firm would pay the Fellow stipends under the
Program.
09-555 (Kirkpatrick.):
Re: Whether, as a Pharmacist with the
Pennsylvania Department of Public Welfare under job
code 32710, you would be considered a “public
employee” subject to the Public Official and Employee
Ethics Act (the “Ethics Act”), 65 Pa.C.S. § 1101 et
seq., and the Regulations of the State Ethics
Commission, and particularly, the requirements for
filing Statements of Financial Interests.
09-556 (Kuhn):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
member of a municipal authority board with regard to
simultaneously serving as a part-time borough code
enforcement officer.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon a
borough council member, who in a private capacity is
employed by a construction company, with regard to
the award of borough contract(s) to the aforesaid
company.

would impose any prohibitions or restrictions upon the
former A with regard to serving on a B of a [type of

would impose any prohibitions or restrictions upon a
member of a municipal authority board with regard to
working as an employee of the municipal authority or

authority.
09-560 (Rittenhouse):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon: (1)
a township supervisor, who in a private capacity is
employed by PECO Energy Company as the County
Affairs Manager, with regard to participating in the
approval of the payment of the monthly township
expenses, where such expenses would include a
monthly utility bill from PECO for electric services; or
(2) a township supervisor, whose son is employed by
the township in the labor department of the
wastewater treatment plant, with regard to
participating in the approval of the payment of the
monthly township expenses, where such expenses
would include his son’s compensation as part of
payroll.

Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any restrictions upon employment of a
Traffic Control Specialist Manager following
termination of service with the Pennsylvania

09-002 (Crompton):
Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose any prohibitions or restrictions upon an
individual employed as counsel (“Counsel”) to the
President Pro Tempore of the Pennsylvania Senate
where: (1) Counsel would give a speech in his official
capacity to an organization or similar entity (“the
Organization”); (2) the Organization would elect to
donate $150 to a non-profit entity (“the Donee”) in
Counsel’s name in appreciation of the speech; (3)
Counsel would not select the Donee; (4) the Donee
would have no connection with Counsel or the
Pennsylvania General Assembly; and (5) Counsel
would not agree to give the speech contingent upon
the donation to the Donee.
